Terms of Service
Welcome to Arhden – Rhelos: Olam Eternal (the "Game"). These Terms of Service (the "Terms") are a binding agreement between you and Arhden, an Oklahoma business that will operate as Arhden LLC once formed ("Arhden," "we," "us"). They cover the Game, the Arhden Game Entry, Launcher and Eternal FrontEnd programs, the website at arhden.com, our community spaces, and every related service (together, the "Services").
Please read Section 17 carefully. It requires most disputes to be settled by individual binding arbitration instead of in court, and it waives class actions. You may opt out within 30 days.
By creating an account, signing in, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Who may play
- You must be at least 13 years old. If you are under 18 (or the age of majority where you live), a parent or legal guardian must review and agree to these Terms for you, and is responsible for your use of the Services and any purchases.
- You may not use the Services if you are barred from doing so under the laws of the United States or the country where you live, or if we have previously banned you.
2. Your account
- One person per account. Your account is personal. Do not share, sell, rent or give it away, and do not use anyone else's.
- You may own more than one account, but you may not use multiple accounts to cheat, dodge a penalty, or harm other players or the Game's economy.
- Give accurate information and keep your email address current. You are responsible for keeping your password secret and for everything done through your account. Tell us at once at [email protected] if you think your account has been used without your permission.
- Character names and account names must follow the Code of Conduct (Section 7). We may change any name that does not.
3. Our license to you
As long as you follow these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Game software and the Services for your own non-commercial entertainment. You may not copy, sell, modify, reverse engineer, decompile, or make derivative works of the software or the Services, except where the law expressly allows it despite this limit, and you may not run private or emulated servers of the Game.
4. Virtual items, characters and currency
Characters, items, coin, property, titles and everything else inside the Game ("Virtual Items") are part of the Services. They have no real-world money value, cannot be redeemed for cash, and are licensed to you, not sold. We may change, rebalance or remove Virtual Items as part of running the Game.
Real-money trading is not allowed. You may not buy, sell or trade accounts, characters, Virtual Items or services for real money or anything outside the Game, or advertise such trades. Accounts involved may be suspended or banned.
5. Subscriptions, payments and refunds
- Free play. Each account may play one free character for up to 20 hours each calendar month. Unused hours do not carry over.
- Paid plans. Your first paid character costs $5 per month or $50 per year; each additional character costs $2 per month or $20 per year. All of an account's plans are billed together in one charge. Prices are in U.S. dollars and do not include any tax we must collect.
- Automatic renewal. Paid plans renew automatically at the end of each monthly or yearly period, at the price then in effect, and your payment method is charged unless you cancel before the renewal date. We will email you before each yearly renewal, and before any price change takes effect.
- Canceling. You can cancel at any time from your account page on arhden.com or by emailing [email protected]. Canceling stops future charges; your plan stays active until the end of the period you already paid for.
- Refunds. If you are not satisfied with your first purchase of a plan, ask within 14 days and we will refund it. Otherwise payments are non-refundable and we do not refund partial periods, except where the law requires it. Nothing here limits refund rights you have under the law where you live.
- Payments are handled by third-party payment processors under their own terms. We never see or store your full card number. If a payment fails or is reversed, we may pause the paid features of your account until it is resolved.
- We may offer discounts, including an accessibility discount for blind and low-vision players. Proof of eligibility is reviewed privately and is not kept once approved (see the Privacy Policy).
6. Testing and early access
Before official launch, the Services are in testing ("beta"). Beta features may be unfinished, unstable or removed, and characters, items and progress may be reset or wiped, including at launch. We will try to give notice, but are not required to.
7. Code of Conduct
Arhden is a shared world. While using the Services you agree not to:
- harass, threaten, stalk, bully or impersonate anyone, including staff;
- post hate speech, or content that demeans people because of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability or age;
- post sexual content involving minors (we report it to the authorities), or sexually explicit or graphically violent content outside what the Game itself depicts;
- share another person's private information, or ask other players for their passwords;
- cheat, or use bots, or software that plays the Game for you while you are away from the keyboard;
- exploit bugs or glitches for advantage instead of reporting them (good-faith bug reports to [email protected] are welcome and never punished);
- attack, overload, probe or interfere with our servers or networks, or access parts of the Services you are not authorized to;
- spam, advertise, scam or phish; or
- break any law, or help anyone else do any of the above.
Accessibility tools are always allowed. Screen readers, magnifiers, braille displays, text-to-speech, MUD clients, and simple macros or aliases that send commands only when you trigger them are welcome. If you are unsure whether a tool is allowed, ask us first.
8. Enforcement
We may investigate suspected violations and take action, which usually moves from a warning, to a temporary suspension, to a permanent ban. For serious violations (such as threats, illegal content, fraud or hacking) we may skip straight to a ban. We may also remove content, rename characters, or remove Virtual Items gained through a violation. No refunds are given for accounts suspended or banned for breaking these Terms. If you think we made a mistake, write to [email protected] and a person will review it.
9. AI-driven characters
Many townsfolk and other characters in the Game are driven by artificial intelligence. Their words and actions are generated by software, are part of the fiction, and are not statements of fact, advice, or the views of Arhden. Do not rely on them for real-world information. Your conversations with them may be reviewed and used to improve the Game, as described in the Privacy Policy. We never sell them.
10. Chat, logs and moderation
In-game chat and commands are recorded and may be reviewed by staff for safety, support and enforcement. Do not share anything in the Game you would not want staff to read. We are not obliged to monitor everything and are not responsible for what other players say.
11. Content you create
You own what you write: character names, descriptions, roleplay, posts and similar content ("Your Content"). By posting it in the Services you give Arhden a worldwide, royalty-free, non-exclusive, perpetual license to host, store, copy, display, adapt and share Your Content as part of running and promoting the Game (for example, quoting a great roleplay scene on our website). You confirm you have the right to post Your Content and that it does not break these Terms or anyone else's rights. We may remove any content at our discretion.
If you send us ideas or suggestions, we may use them freely without paying you or owing you anything.
12. Our content and copyright complaints
The Game, its world, lore, text, art, code, names and logos belong to Arhden or its licensors and are protected by copyright and trademark law. "Arhden" and "Rhelos: Olam Eternal" are our trademarks.
If you believe something in the Services infringes your copyright, email [email protected] with the subject "Copyright Notice" and include: your contact details; the work you say is infringed; where the material is in the Services; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorized to act for the owner; and your physical or electronic signature. We respond under the U.S. Digital Millennium Copyright Act and may close the accounts of repeat infringers.
13. Changes to the Services
Online games keep changing. We may add, change or remove features, content, rules, prices or Virtual Items at any time. If we ever shut the Game down, we will give at least 60 days' notice on arhden.com and by email, stop charging renewals, and refund any prepaid subscription time left unused at shutdown.
14. Ending these Terms
You may stop using the Services and ask us to delete your account at any time. We may suspend or end your access as described in Section 8, or if we are required to by law. Sections that by their nature should survive (such as 4, 11, 12 and 15 through 19) survive after these Terms end.
15. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, ARHDEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT DATA WILL NEVER BE LOST. Some places do not allow these disclaimers, so they may not all apply to you.
16. Limit of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, ARHDEN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR VIRTUAL ITEMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50. These limits do not apply where the law forbids them, such as for fraud, gross negligence or death or personal injury caused by us.
You agree to defend and hold harmless Arhden from claims by others that arise from your breaking these Terms or the law.
17. Disputes: arbitration and class action waiver
- Talk to us first. Before filing any claim, email [email protected] with the subject "Dispute" describing the problem and what you want. We will try in good faith to resolve it within 60 days.
- Binding arbitration. If we cannot, any dispute between you and Arhden relating to the Services or these Terms will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration may be held by video or phone, or in your home county. For claims under $10,000 we will pay the filing and arbitrator fees beyond what you would pay to file in court. The Federal Arbitration Act governs this section.
- Exceptions. Either of us may bring an individual claim in small claims court, and either of us may go to court to stop infringement or misuse of intellectual property.
- No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, group or representative action. There is no jury trial.
- Opt out. You may opt out of this Section 17 by emailing [email protected] with the subject "Arbitration Opt-Out", your account name, and a statement that you opt out, within 30 days of first agreeing to these Terms.
- If you live in the European Union, the United Kingdom, or another place whose laws do not allow this section to apply to consumers, it does not apply to you, and you may use your local courts and consumer dispute bodies.
18. Governing law
These Terms are governed by the laws of the State of Oklahoma and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute not sent to arbitration will be heard only in the state or federal courts located in Oklahoma, and you and Arhden consent to their jurisdiction. If you are a consumer outside the United States, you keep the protection of the mandatory laws of your country.
19. General
- Changes to these Terms. We may update these Terms. For important changes we will give at least 30 days' notice by email and on the sign-in screen before they take effect. Continuing to use the Services after that means you accept the new Terms.
- These Terms and the Privacy Policy are the whole agreement between you and Arhden about the Services. If any part is found unenforceable, the rest stays in effect. If we do not enforce a part right away, we have not given up the right to do so later.
- You may not transfer these Terms. We may transfer them, for example to Arhden LLC when it is formed, or to a buyer of the Game.
- We are not responsible for delays or failures caused by events outside our reasonable control, such as power or internet outages, storms or other natural events.
- These Terms are written in English. Any translation is for convenience only.
